General Terms and Conditions of Sale and Delivery for TitaniumShop.com
- Applicability These general terms and conditions of sale and delivery (the “Terms”) apply to all purchases of products from BrightRock AB (TitaniumShop.com, the “Seller”) and are binding for both parties (the “Parties”) unless otherwise agreed in writing.
- Orders and Agreements An order becomes binding when the Buyer completes the purchase on TitaniumShop.com. A confirmation email is automatically sent. Orders cannot be canceled after confirmation, as packing may have already started, and certain products are cut to the Buyer’s specifications.
- Prices and Payment Prices are stated in EUR or local currency, excluding VAT and any applicable customs duties. VAT is added for customers located in Sweden. The Buyer pays in advance through the checkout using a credit card or a third-party payment solution offering invoice and payment options. Any late payment interest is handled by the payment provider.
- Delivery and Transfer of Risk Delivery is made according to CPT (Carriage Paid To) via FedEx:
- FedEx International Priority Express (1-3 business days)
- FedEx International Economy (2-5 business days)
- Packing and booking take an additional 2-3 business days beyond shipping time. The Buyer pays shipping costs once per order, and partial deliveries are not made, unless otherwise agreed. The risk transfers to the Buyer upon handover to the carrier.
- Delivery Delays The Seller is not responsible for delays caused by the carrier or other circumstances beyond the Seller’s control. The Buyer may request order cancellation due to delivery delays exceeding 30 days beyond the estimated delivery time, but cancellation is subject to the Seller’s approval.
- Inspection and Complaints The Buyer must inspect the goods upon receipt and report any defects in writing within 14 days. If no complaint is made within this time, the goods are deemed accepted.
- Liability for Defective Products If a delivered product is defective, the Seller has the right to either rectify the defect, replace the product, or credit the corresponding amount at its discretion. Return shipping costs are covered by the Seller only for valid complaints. Fault-free products cannot be returned, as all products are customized according to the Buyer’s order.
- Limitation of Liability The Seller disclaims all liability for indirect damages, including production stoppages, lost revenue, and other economic losses incurred by the Buyer. The Seller is not responsible for damages occurring during transport. Tolerances for weight, length, and quality can be found here: TitaniumShop.com/quality.
- Force Majeure The Seller is not liable for delays or damages caused by circumstances beyond its control, such as natural disasters, war, strikes, or other force majeure events.
- Retention of Ownership The Seller retains ownership of delivered products until full payment has been received.
- Dispute Resolution
- Disputes under 50,000 EUR shall be settled in general courts in Sweden.
- Disputes over 50,000 EUR shall be resolved by arbitration at the Stockholm Chamber of Commerce Arbitration Institute (SCC). Swedish law applies to these Terms.
